IDS expands mortgage eClosing platform with addition of eVault

With the addition of the eVault to Solitude Solution, lenders now have the ability to deliver documents, including eNotes, to partners though Mortgage Electronic Registration Systems, Inc. The IDS eVault is approved by Fannie Mae and Freddie Mac and includes secure eDelivery and eTransfer functionality for digital mortgage documents, allowing lenders to quickly and easily register eNotes with MERS. Prior its release, the eVault underwent a beta testing phase, during which IDS collected feedback on the product.

This allows the lender to begin the processes of registering the eNote with MERS, sending the eNote to parties such as the master services via eDelivery and transferring the ownership of the eNote via eTransfer.

"As the three groups representing the interests of the major players in the real estate transaction - mortgage lenders, title/settlement companies and real estate agents - these entities are uniquely suited to craft a model that addresses the specific challenges of implementing RON for real estate transactions, and on behalf of IDS, I would like to extend my sincere thanks to these groups for addressing this issue head-on."

As noted in a July 1 article in MBA NewsLink, the MBA's official electronic publication, "The model executive order, designed for use by state governors, proposes legal protection of remote notarizations to preserve the public's health and well-being in light of COVID-19. The order emphasizes use of electronic documents and virtual communications to satisfy the legal requirements of notarizations." The draft model also seeks to provide greater legal certainty for mortgage transactions conducted using remote ink notarization (RIN), which many states opted to approve in their respective temporary authorizations rather than RON.

"While RON is certainly the preferable of the two methods, it is easy to see, in light of the larger implementation hurdle RON presents, why states would opt for RIN in their initial round of temporary measures," Mackey added. "However, states should view RIN as just that - a temporary measure to help address immediate concerns - while also committing to the goal of putting the legislative mechanisms in place to make RON the long-term solution."

Changes to the system included Loan Estimate (LE) Estimated Cost Expiration date inputs, the availability of Alternative LE/Closing Disclosure (CD) forms for simultaneous subordinate financing, disclosure of seller paid fees and principal reductions, data entry for the Summary of Transactions and Liabilities and Payoffs, and updates to the rounding and truncation of percentages. There were also TRID 2.0-related updates made to the LE/CD and Totals pages and the 1003 and Construction Lending sections in idsDoc.

In addition, IDS rolled out a brand new interface with MortgageFlex Systems in October 2018 that operates on the MISMO Version 3.3 data standard, ensuring joint IDS-MortgageFlex customers are able to fully comply with a host of regulatory requirements that operate off the MISMO Version 3.3 standard, including the UCD and TRID 2.0.

These efforts earned several IDS employees industry recognition in 2018. "If they have not already done so, we highly encourage our clients to make themselves familiar not only with the amendments to the TRID rule, but also the corresponding changes with idsDoc prior to October 1 to ensure a successful implementation."

In addition to the document-related changes outlined above, TRID 2.0 also closes the "black hole" created by the initial version of the rule, thus allowing lenders, in certain instances, to reissue a CD to reset tolerances after the original CD was issued.

"With TRID 2.0, the Consumer Financial Protection Bureau has offered some much-needed clarity on the issue of under what circumstances lenders can re-issue the CD without penalty," Mackey added. "This, along with the other rule clarifications contained in TRID 2.0, should give lenders greater certainty that they are operating within both the letter and spirit of the regulation."

Santos was recognized for product development contributions that have led to IDS's growth in the market. In 2017, she helped increase development of new products and features within idsDoc by 22 percent, oversaw the addition of 218 new audits to idsDoc, managed a 42 percent increase in closing document production and launched idsDoc features that support new Uniform Closing Dataset (UCD) requirements.

Most recently, Santos played a crucial role in enhancements to IDS' loan operating system (LOS) integrations, including the addition of a document preview feature that allows idsDoc users to preview mortgage documents within their LOS before being submitted to fulfillment. Additionally, she has directed the construction and seamless roll-out of IDS' Hybrid eClosing solution by servicing as a go-between for IDS's Development, Operations, and Compliance teams.

Veros and IDS Partner on Integrated Solution for Fannie Mae and Freddie Mac UCD Data Submissions

The Veros and IDS partnership creates a fully integrated UCD data file creation solution and submission solution. By offering lenders a single, integrated solution - similar to the Uniform Collateral Data Portal (UCDP) - and combining IDS's UCD XML file creation capability with Veros' Pathway UCD submission system, both Veros and IDS ensure full compliance with the GSEs' June 25, 2018 mandate.

According to a January 30, 2018 joint announcement made by Fannie Mae and Freddie Mac, warning UCD edits in the GSEs' respective delivery systems related to non-submission or unsuccessful UCD submission will become critical or fatal effective June 25, 2018. In addition to the edits that will turn fatal in the GSEs' delivery systems, the UCD warning edit for embedding the PDF will also convert to fatal, resulting in a "Not Successful" status, as of the June mandate.

Both GSEs are recommending that lenders prepare for the change by submitting "Successful" UCD files prior to delivering their loans, as appropriate. In response to the joint announcement from January, IDS has updated its proprietary idsDoc platform to support the directive and issued a press release on April 11, 2018 urging lenders to begin troubleshooting UCD files that resulted in a "Not Successful" status.
