NEWPORT BEACH, Calif. /ScoopCloud/ -- NotaryCam(R) Founder and CEO Rick Triola today hailed the efforts of the American Land Title Association (ALTA), Mortgage Bankers Association (MBA) and National Association of Realtors (NAR) to provide guidance and standardization for states seeking to temporarily authorize the use of remote online notarization (RON) for real estate closings. To date, all but seven states have some form of RON legislation or executive order in effect.

"NotaryCam has observed first-hand for some time the simplicity, security and convenience RON brings to the real estate closing ceremony, and while we wish the circumstances surrounding this joint effort were quite different, we applaud these trade groups for banding together to provide states with the necessary language to fortify the legal underpinnings of remotely executed notarial acts and provide real estate professionals with a measure of standardization regarding the particulars of these orders," Triola said.

"Prior to the onset of the COVID-19 pandemic, only 22 states had passed RON legislation, and even fewer had those laws in effect at that time. Thus, the majority of states had to pass temporary executive orders to allow the notarial act to be completed remotely in some form or fashion, many of which only authorized remote ink notarization (RIN) rather than RON," Triola continued. "While RIN provided a necessary stopgap early on, it is not a scalable or sustainable solution, particularly for real estate transactions. With COVID-19 cases continuing to rise and a vaccine still a distant possibility, states would be well advised to extend and expand their current orders to make RON the de facto method of document notarization for the near future."

Remote Online Notarization Taking Hold in Florida, NotaryCam Reports

NEWPORT BEACH, Calif. /ScoopCloud/ -- NotaryCam(R), the pioneering leader in online notarization and original provider of mortgage eClosing solutions, announced it has observed a significant increase in remote online notarization (RON) adoption and utilization for real estate transactions in Florida over the past three months. Since January 1, which is the date Florida's RON law went into effect, the company has experienced a 100% month-over-month increase in RON closings.

"With such a high concentration of property transactions being executed by out-of-state residents, Florida represents a great use case for RON," said NotaryCam Founder and CEO Rick Triola. "Our volume of Florida RON closings is doubling almost every other day, and we have signed hundreds of new partners in the past three months. According to the Florida Realtors(R) association, international buyers accounted for 36,400 of all existing home sales in the state between August 2018 and July 2019, which represents $16 billion in volume. The association also estimates that the vacation/rental-home business accounted for $27.4 billion in sales within the state in 2018. This bill addresses several uncertainties previously acknowledged in regard to remote online notarization (RON) in Texas. Under this bill, a notary will be able to certify via an affidavit that a paper copy of a notarized electronic record is a true and correct copy, and county clerks will be required to record the transaction.

"Even though RON has been legal in Texas for nearly a year, nuances in the state's real estate laws legislation have created unforeseen roadblocks to adoption. However, the passage of SB 2128 should remove the final hurdle for RON adoption in Texas," Triola said. "By passing this bill, the Texas legislature has removed doubt that a properly executed RON transaction will be accepted by county recorders statewide, thus paving the way for mortgage lenders and title/settlement professionals to begin executing remotely notarized and closed Texas-based real estate transactions."

According to data from the Property Records Industry Association (PRIA), only 71 (*see note 1) of the 254 counties in Texas current offer eRecording. Thus, with the vast majority of counties lacking the capabilities to eRecord, the Texas legislature correctly recognized the current state of affairs and enacted a solution to allow RON transactions to move forward regardless of a particular jurisdiction's recording procedures.

"On a practical level, SB 2128 expands the definition of a paper document to include electronic records that have been 'papered out,' thus removing any doubt that these documents are eligible to be recorded in the state of Texas," said Celia Flowers, owner of East Texas Title. "After talking to my clerks after the original RON statute went into effect last year, I quickly discovered that many of them did not know about the bill, nor did they understand what RON was. As a result, many of them - especially those that did not eRecord - were not going to accept documents that had been electronically notarized. I think this bill resolves many of the concerns clerks had regarding RON by providing a legally accepted framework for converting electronic document into paper format for recording purposes."

Triola and Flowers, along with the Texas Land Title Association's Director of Government Affairs and Counsel Aaron Day and James Anderson from Championship Title, will be sharing lessons learned from Texas's roll-out of RON at the ALTA ONE conference in Austin.

They might not sign in all the right places and then send back incorrectly executed documents, which really holds up the transaction. Specifically Triola cites the positive impact of recommendations in the report's section Electronic Closing and Recording (p. 107 - 110), in advancing the industry's adoption of remote online notarization:

Treasury recommends that states yet to authorize electronic and remote online notarization pursue legislation to explicitly permit the application of this technology and the interstate recognition of remotely notarized documents. Treasury recommends that states align laws and regulations to further standardize notarization practices. Treasury further recommends that Congress consider legislation to provide a minimum uniform national standard for electronic and remote online notarizations. Such legislation would facilitate, but not require, this component of a fully digital mortgage process and would provide a greater degree of legal certainty across the country.

"The key phrase here is 'legal certainty,' which, if achieved, knocks down any barriers for a lender or a title company or other industry participant to offer the convenience and security of doing these transactions online," Triola said. "Consumers are asking for this. Consumers are tech savvy and they want the convenience of tech-enabled financial transactions."

"In my opinion, the biggest problem with technology innovation in our industry is that it never gets to the end user because so many barriers to adoption are created. Consumers don't even know the technology exists to allow remote online notarization that they can complete from anywhere, at any time. This option should be available to any consumer who wants it.

"It allows the lenders and the title companies to move forward and to offer this convenience to all stakeholders including the end user. And that's exciting," he said.

Triola also sees promise for the industry's drive to a more fully digital mortgage transaction, citing the following from the report:

"Getting to a full complete electronic real estate mortgage transaction has been an achievable goal for years, but the laws were not on the books that allowed for this to happen," Triola said.

While the Treasury's recommendations are a great and necessary start, encouraging all states to get on board, Triola thinks national legislation will be needed.

"What is needed is to give title underwriters, lenders, and investors comfort that the e-transaction is not going to be challenged by a foreclosure judge or a bankruptcy judge. Those concerns hang out there now because there's no case law to solidify support for the current legislation in Virginia or Montana, for example.

"Obviously," Triola said, "they had extensive conversations with MBA and ALTA to understand the barriers for adoption and they've addressed them, so it's very exciting."
