Levy Konigsberg LLP Wins $43.1 Million Lung Cancer Verdict in Tobacco and Asbestos Exposure Case

BOSTON, Mass. /ScoopCloud/ -- Late Friday afternoon, on October 12, 2018, a jury in Boston awarded $43.1 million dollars in a historic lung cancer trial involving both tobacco and asbestos claims. The case began in June of 2015 when Levy Konigsberg LLP, and its co-counsel Shepard Law, filed the case on behalf of Louis E. Summerlin and his wife Joanna M. Summerlin, against R.J. Reynolds Tobacco Company (“Reynolds”), Philip Morris USA, Inc. (“Philip Morris”) and numerous companies who manufactured and sold asbestos-containing products with which Mr. Summerlin worked as a brake mechanic. (*Note 1)

Before his death in October 2015, Mr. Summerlin gave sworn, videotaped testimony in the case, which was presented to the jury during trial. Mrs. Summerlin continued the action on behalf of herself and the Estate of Mr. Summerlin. Prior to trial, four companies against whom asbestos-related claims were brought settled the claims against them. The case proceeded to trial beginning on September 7, 2018 against Reynolds and Phillip Morris (the companies who manufactured and sold the cigarettes Mr. Summerlin smoked) as well as Hampden Automotive Sales Corporation (“Hampden”), a manufacturer of asbestos-containing brakes that Mr. Summerlin used in the late 1950s through early 1960s.

The jury heard evidence that Mr. Summerlin began smoking as a teenager in the late 1950s, before warnings were put on cigarette packs. When Mr. Summerlin first tried smoking he coughed and gagged on the smoke. But he then tried a menthol cigarette which -- due to the anesthetic properties of menthol – was easy for Mr. Summerlin to inhale which led to Mr. Summerlin becoming a daily cigarette smoker. The jury heard testimony from multiple expert witnesses regarding Mr. Summerlin’s 50-plus year addiction to menthol cigarettes (including Kool, Salem and Marlboro Menthol), as well as his unsuccessful attempts to quit using smoking cessation aids such as nicotine gum, the nicotine patch and a prescription drug (Chantix). At trial the Plaintiff called experts in a variety of specialties including: nicotine addiction, health behavior, tobacco industry conduct, history, industrial hygiene, and occupational and environmental medicine.

After a 5 week trial, the jury deliberated for over 23 hours during the course of 4 days, before rendering a verdict against Reynolds, the maker of the menthol cigarettes (Kool and Salem) that Mr. Summerlin smoked from the late 1950s through the mid-1980s. The jury found Reynolds liable on all 5 counts: breach of implied warranty of merchantability (defective design and inadequate warning); negligence (negligent design and failure to adequately warn) and fraud. The jury awarded $5.3 million for Mr. Summerlin’s pain and suffering, $3.5 million for Mrs. Summerlin’s “loss of consortium”, $4.3 in wrongful death damages, for a total of $13.1 million in compensatory damages.

The jury also found that Reynolds was “grossly negligent” and acted “maliciously, willfully, wantonly or recklessly” in causing Mr. Summerlin’s lung cancer, and awarded $30 million in punitive damages. Although the jury found that Philip Morris and Hampden breached the implied warranty of merchantability in selling “defective” products, the jury determined that these breaches were not a “substantial contributing factor” in causing Mr. Summerlin’s lung cancer, resulting in a defense verdict in favor of these two companies.

The case was tried by Jerome H. Block, partner at Levy Konigsberg LLP, and Michael Shepard, founding partner of Boston-based Shepard Law. The trial team also included Robert Ellis and Amber Long (Levy Konigsberg) and Michael McCann and Erika O’Donnell (Shepard Law). Mr. Block commented on the verdict, stating: “Throughout the trial Reynolds and its co-defendants attempted to avoid responsibility by blaming Mr. Summerlin, despite his severe addiction to menthol cigarettes. We are gratified that the jury determined that Reynolds’ outrageous conduct not only caused Mr. Summerlin’s lung cancer, but recognized the significant damages suffered by the Summerlin family and the need to punish Reynolds with punitive damages.”

Premiere Set for ‘Dead in the Water,’ a Film on the ‘Relentless Destruction’ of Ground Fishing Industry

ROCKPORT, Mass. /ScoopCloud/ -- A documentary film dealing with the devastating impacts of federal regulations on the lives of New England ground fishermen, "Dead in the Water," produced and directed by Rockport native and professional filmmaker David Wittkower, will be screened for the first time in public in Rockport, Massachusetts on Nov. 18.

"Dead in the Water" was two-and-a-half years in the making and is Wittkower's fifteenth documentary film.

The film was shot in different coastal towns and it features scenes and interviews with area fishermen, their spouses and other family members; advocates for fishermen; elected officials; and community activists.

"This film opens the doors for the world to see how difficult and dangerous the life of a fisherman is," said John Bell, a former three-term mayor of Gloucester (2002-08). "On top of that, the impact of misguided federal regulations on fishermen has never been presented as powerfully as it is in 'Dead in the Water.' This film packs a real punch. It stays with you long after you've seen it."

Wittkower, a graduate of the American Film Institute as a cinematographer, who's been living and working in Los Angeles since 1981, describes "Dead in the Water" as an examination of "the relentless destruction of the New England ground fishing industry through government regulations, bad science, and the growing, but mistaken, belief that everything has been overfished and there aren't any fish left in the oceans."

The idea for the film came from a casual conversation he had on a sidewalk in Gloucester three years ago. "I was back in Rockport on a visit and I drove into Gloucester and noticed there were very few fishing boats in the harbor," Wittkower said. "I asked someone, 'Where's the fleet?' and he said, 'What fleet? The fleet's been dwindling for years, and this is what's left.'"

He started asking more questions about the plight of the town's fishermen and was soon directed to Angela Sanfilippo, the longtime president of the Gloucester Fishermen's Wives Association. Sanfilippo encouraged him when he raised the possibility of telling the story of the vanishing fleet of ground fishing boats and their crews on film.

"I could see that David was sincerely interested in this topic," said Sanfilippo, "and I quickly figured out he had the skills and track record to make a serious documentary on it, a film that could generate a lot of interest, here and elsewhere."

The Gloucester Fishermen's Wives Association decided to help and support Wittkower as much as possible. "The first time I saw the rough cut of 'Dead in the Water,' I knew we had done the right thing," said Sanfilippo. "This is something special."

One of the many friends and professional colleagues of Sanfilippo who appears in "Dead in the Water" is J.J. Bartlett, President of Fishing Partnership Support Services. He notes that physicians who have studied the physical and emotional effects upon ground fishermen of the changes in the industry "have concluded that 87 percent of them are suffering from symptoms of post-traumatic stress disorder (PTSD)."

Bartlett said, "When you watch 'Dead in the Water,' you'll understand why that's so. And you'll leave the theater wanting to tell your friends, 'You have to see this film.'"

The film also includes the song, "Gloucester Harbor Shore" by Grammy(R) Award winner, Paula Cole.

Following the premiere in Rockport on Nov. 18, Wittkower is planning a tour where he will show the film in multiple locations and to a variety of audiences. That tour will begin in Massachusetts, with subsequent showings likely in Boston and New Bedford, and will extend to Maine and other coastal states. Simultaneously, he will be trying for a nationwide showing by getting the film on HBO, Netflix or Amazon.

"Dead in the Water" is Wittkower's fifteenth documentary film. He has won many awards for his work, including one from the National Cowboy & Western Heritage Museum for a film he did on Lane Frost, a famous rodeo bull rider who was accidentally killed at a riding event. He's hoping now that "something better than an award" will come from his latest project.

Said Wittkower, "I'm hoping to increase public support for U.S. fishermen. I want to help keep fishing jobs in this country. If 'Dead in the Water' can do that, I'd be pretty happy."

The film was recently accepted as Official Selections into the Depth of Field International Film Festival competition under three categories: Documentary, Direction and Cinematography.

Through the hard work of Solarize volunteers and the SunBug team, Solarize Mass WCGW surpassed the highest pricing tier, resulting in the lowest possible prices for all customers. Over the six-month timeframe, SunBug signed up 90 families representing 767kW of solar.

Knox Trail Council and Old Colony Council Approve Merger

MARLBOROUGH, Mass. /ScoopCloud/ -- Following their respective Special Council Meetings, the Knox Trail Council and the Old Colony Council announced today the approval of their consolidation and merger to form a new Boy Scout Council. This new council will serve youth and young adults from the metrowest to southeastern Massachusetts.

"We're thrilled that our volunteer leaders voted to move forward with the merger plans of these two healthy councils. This creates a firm foundation for scouting to thrive in our region for years to come," said Knox Trail Council President Sherry Bowden.

Old Colony Council President Rob Hillman added, "We worked closely together getting to this point. We are now ready to take the next steps of building a new scouting council which will enhance the programs for our youth."

As a merger of equals a new name will be chosen for the combined council during 2017 which will carry forward the strong traditions of both councils and set the course for a united future.

The consolidation will result in more operating efficiency, thereby freeing up personnel and financial resources that can be reallocated to serve unit leaders, youth and their families. The scout offices in Canton and Marlborough will eventually be replaced by an office in a central location. Camps Nobscot, Resolute, and Squanto are key assets and all three camps will be retained and used by the new council.

The new council will serve over 11,000 young adults in 62 communities around Boston. Knox Trail Council serves 21 towns and cities across the metrowest from Newton to Stow to Westborough to Mendon. Old Colony continues south from the Knox Trail region, serving 41 communities in southeastern Massachusetts from Bellingham to Hull to Plymouth.

The new council will serve young adults with a full range of Boy Scout programs including: Cub Scouts and Boy Scouts for boys and young men from kindergarten to age 18 and the co-ed Explorer and Venturing programs for young men and women in their teens. Currently there are 332 Boy Scout Troops, Cub Scout Packs, Explorer Posts, and Venture Crews across the 62 communities served by the new council.
