Tax Court Case: Engineering Firm Overstated §179D Energy Efficient Commercial Building Property Deduction

COLUMBUS, Ohio /ScoopCloud/ -- In a recent case, Michael Johnson, et ux. v. Commissioner, the tax court denied the majority of a taxpayer's Energy Efficient Commercial Building Deduction under IRC §179D since it claimed a §179D Deduction exceeding the cost of the Energy Efficient Commercial Building Property (EECBP), says ICS Tax, LLC.

Background

The §179D Deduction is a federal tax incentive designed to promote taxpayers to construct energy efficient buildings as well as encourage building owners to make improvements to existing structures that reduce energy and power costs. At the time of the case, the §179D Deduction provided a maximum deduction of up to $1.80 per square foot of the building's floor area and applies to interior lighting systems, heating, cooling, ventilation, hot water systems or building envelope. A special rule under §179D provides that architects, engineers, contractors, environmental consultants or energy services providers may also be eligible for the incentive on public projects. However, the amount of the §179D Deduction is limited to cost of the EECBP.

The Case

In this case, the taxpayer was an engineering firm in the business of installing heating, ventilation, and air conditioning (HVAC) systems. The taxpayer installed HVAC systems in a U.S. Dept. of Veterans Affairs (VA) hospital. This engineering firm had the §179D Deduction allocated to them such that they claimed a deduction of $1,073,237 for the 2013 taxable year, which was equal to the product of $1.80 and 596,243, the hospital's square footage. However, the cost of the EECBP was only $304,640. Hence, the tax court concluded that the §179D deduction was limited to the $304,640 cost of the EECBP.

Many professional service providers lack the expertise to properly analyze the complex tax rules and engineering requirements for the §179D Deduction. For a tax incentive requiring both a thorough knowledge of the tax code and engineering principles, it is essential to hire a fully qualified and experienced team that includes CPAs, attorneys, and professional engineers. In 2018, filmmaker David Bynum began the emotional journey to find his biological family. The feature-length film documents his search to discover who he is and where he came from. The story is told by the people who assisted him along the way.

"From A Place of Love - My Adoption Journey" will premiere April 9, 2021, on streaming services, iTunes/Apple TV, Google Play/YouTube Movies and VUDU. In addition, on July 1 it will begin streaming on Tubi, Xumo and redbox. Currently it's available for Digital Download or Collector's Item DVD on the film's website.

Adoption Network Cleveland recently screened the film as part of the Monday Night Speaker Series. Adoptee Debra Parker Sparrow said, "David, I felt blessed to have seen your journey. I can't wait to share it with others."

"It made me laugh, it made me cry, but most of all it made me feel good. Thank you for sharing your story," said Denny Baker, Stowe, PA.

The film's objective is to give people affected by adoption a clear view of all that goes into the emotional journey of search & reunion. It shows the methods used to find both sides of the filmmaker's biological family in 11 weeks, along with the preparations necessary for the emotional roller-coaster ride associated with the journey.

The film features an original soundtrack scored by Central Ohio composer Doug Espie and original music from Ohio music legend Dean Francis. Ohio Media School graduates Steffon Weston & Mar Jae spearheaded the production team.

"By far, this was the most emotional thing I've ever done in my life. I made this film with the intention of finding the closure I was seeking, while helping others in similar situations," said David Bynum - Director, "From A Place of Love - My Adoption Journey."

David added, "It can be used as a formula to begin their search if they so desire. It explains the things necessary to prepare yourself mentally, physically, and emotionally for whatever you find along your journey. Fortin Ironworks Reflects on 75 Years Serving Central Ohio

The founders, Joe and Josephine Fortin, a 22-year-old Italian American couple, were initially introduced as friendly pen pals during World War II when Joe was stationed in Iran for the U.S. Army. Shortly after their August wedding in 1945, World War II ended. Joe was honorably discharged and the couple's long-distance relationship turned into a love-filled life together.

Jobs were difficult to find after the war, so Joe took matters into his own hands, quite literally. A former welding student of the Columbus Trade School at Fort Hayes in Central Ohio, a welder for the Pennsylvania Railroad and the U.S. Army, Joe was incredibly handy to have around and started doing on-site, portable welding repairs and small metal fabrication jobs.

What started out as a small repair shop run out of his truck and a backyard shed, grew into a thriving business. In 1946, this backyard operation officially became Fortin Welding, now known as Fortin Ironworks. Today, it's a successful, multimillion-dollar company with a modern factory complex on nearly four acres. In fact, the building and its showroom are now local landmarks.

The Fortin Ironworks showroom is a known "destination location" for locals and out of town travelers, alike. Its products can also be found at the Market at Fortin Ironworks, home to the creations of various local artists, eclectic home furnishings and a unique event space available to rent for small gatherings.

Over the years, the business has seen many changes and, most recently, the addition of a high-tech laser machine has allowed it to grow even more and to accommodate unlimited ideas.
