IRS Releases Updated Practice Unit for Auditing the 179D Energy Efficient Commercial Buildings Deduction

EGAN, Minn. /ScoopCloud/ -- The IRS Large Business and International (LB&I) Division released an updated Practice Unit for its agents to audit the 179D Energy Efficient Commercial Buildings Deduction (179D Deduction), ICS Tax, LLC announced today. It confirms that taxpayers can use the ASHRAE Standard 90.1-2007 rather than newer, more strict standards but also could be an indication that the IRS will have added scrutiny on 179D projects.

179D DEDUCTION BACKGROUND

The 179D Deduction was enacted to encourage taxpayers to make buildings more energy efficient. Installation of energy-efficient commercial building property (EECBP) occurs when constructing a new, or improving an existing, commercial or government-owned building.

179D allows a taxpayer who owns or leases a commercial building to deduct the cost or a portion of the cost to install EECBP. Additionally, if the EECBP is installed in a government-owned building, the deduction can be allocated to the person(s) primarily responsible for designing the EECBP ("the Designer" or "the Designers").

EECBP must be part of at least one of three systems:

1 -- Interior lighting systems;

2 -- Heating, cooling, ventilation, and hot-water systems; or

3 -- The building's envelope.

To claim the 179D Deduction, a taxpayer generally hires a third-party Professional Engineer to perform energy modeling using IRS-approved software to confirm that the building meets the 179D requirements. The engineer then prepares a Certificate of Compliance to support the 179D Deduction.

THE ASHRAE STANDARD

The Taxpayer Certainty and Disaster Relief Act of 2020 updated the energy efficiency standard for the 179D Deduction by providing that for EECBP placed in service after December 31, 2020. EECBP means property that is within the scope of "Reference Standard 90.1." Amended 179D(c)(2) provides that "Reference Standard 90.1" means "the most recent Standard 90.1 published by [ASHRAE] which has been affirmed by the Secretary [of the Treasury], after consultation with the Secretary of Energy, for purposes of this section not later than the date that is 2 years before the date that construction of such property begins."

The LB&I revised Practice Unit states "The Secretary of the Treasury has not yet affirmed a new version of Reference Standard 90.1 for use with the IRC 179D deduction.... The ASHRAE Standard 90.1-2007 is the most current affirmed version as of the publication date of this Practice Unit." This means that taxpayers looking to benefit from the 179D Deduction can still qualify under the older ASHRAE standard.

INCREASED 179D SCRUTINY

The IRS recently announced it is looking to hire more than 4,000 representatives. A notable division within the IRS is the Criminal Investigation division. It is the investigative and law enforcement arm of the IRS with expertise in tax fraud, investment fraud, corruption, and much more. Earlier this year, a national tax consulting firm heavily involved with the 179D Deduction was raided by the IRS Criminal Investigation division. While the reason for the raid is not yet publicly known, the raid, the revised Practice Unit and the additional hiring could indicate that the IRS will have higher scrutiny on the 179D Deduction.

Students Complete HBCU Green Fund’s Fellowship – Primed for Growing Opportunities in Clean Energy

A partnership between the HBCU Green Fund and the Russell Innovation Center for Entrepreneurs (RICE), the AUC Fellows Program connects students at Spelman College, Clark Atlanta University and Morehouse College with entrepreneurs and professionals that provided training, mentoring and internships in energy and STEM industries. A grant to RICE from the U.S. Department of Energy provides resources for the program.

"The inaugural AUC fellowship was a huge success," said Illai Kenney, national program director, HBCU Green Fund. "Whether you look at the increase in catastrophic climate events or the impacts of oil on the global economy, the critical need for a swift transition to clean energy is clear. The students were introduced to various energy careers and gained hands-on training in renewable energy technologies. They conducted energy audits of buildings in Atlanta, received instruction on electric vehicle charging stations, and learned to mount solar panels. The program emphasized information on starting an energy-related business and identifying business opportunities. The fellows also attended the annual BIPOC Climate Justice Dialogue, a discussion between climate justice scholars, organizers, academics, and government officials about opportunities in President Biden's Justice40 Initiative.

"It was very helpful to be able to question someone who works in sustainability daily and has created a profitable business in the area," adds Echols, an environmental science major headed into her senior year at Spelman College. "I am excited about the internship the HBCU Green Fund helped me secure at the University of South Florida where I will explore the cultural construction of risk in a peri-urban African American community whose groundwater was contaminated by chlorinated solvents from the former American Beryllium Corporation site."

The AUC Fellows were trained by successful Black entrepreneurs and executives who work in the energy sector; many of them are also HBCU graduates. Jonathan Grammer to Speak at Texas Tech University on Carbon Capture

With now growing global attention and pressure on the need to restrict carbon dioxide emissions, the fossil fuel industry seems to be finding itself in an increasingly tight predicament as it struggles to implement solutions to reduce its carbon footprint. It's a predicament which Grammer believes has plausible solutions that can benefit both the fossil fuels industry as well as the growing renewable markets. It is also one which Grammer, a petroleum landman and attorney and who founded U.S. Carbon Capture in 2021, says has been decades in the making.

"Our team's early work in carbon capture began actually ten years ago in West Texas," states Grammer. "At that time, we were concentrated on separation of the CO2 component from industrial flue gas for utilization in resurrecting several depleted oil fields. We also learned about the reservoir engineering surrounding safely securing CO2 underground."

Now with its qualified team in place and two projects under development, U.S. Carbon Capture has emerged as one of the more likely front-runners in the ever-growing carbon capture market in Texas.

"The issue facing the energy industry in Texas," continues Grammer, "is finding ways to safely preserve utilizing carbon emitting sources in power generation. Carbon dioxide, most commonly associated with the burning of fossil fuels in power plants, oil refineries and other industrial sources can be effectively captured and placed either in underground storage, known commonly as sequestration, or used in enhanced oil recovery. Carbon dioxide, while primarily classified as a pollutant, also has enormous potential as a commodity. Its ability to increase the recovery rate of oil production could prove beneficial to the United States in its large effort to decrease dependency on foreign oil sources."

Seattle company developing wave-powered marine platform for ocean science applications

SEATTLE, Wash. /ScoopCloud/ -- Oscilla Power, Inc. [OPI] is proud to announce the receipt of a $200k Phase I SBIR grant award from the US Department of Energy to develop a wave energy powered platform for ocean sensing and monitoring systems. This award will help to develop technology that enables offshore instrumentation payloads to be powered by renewable energy from the surrounding ocean waves.

During this work OPI will collaborate with CODAR Ocean Sensors, an expert in high-frequency (HF) radar monitoring, to develop a wave-powered instrumentation platform for an offshore HF radar package. Such a system has the potential to greatly expand the range of existing shore-based environmental monitoring.

During this 9-month project, OPI will work with researchers at ECU's Coastal Studies Institute and Oregon State University to develop the marine platform using state-of-the-art optimization algorithms inspired by nature.

There are currently over 8,000 ocean monitoring platforms deployed world-wide, yet the global oceanographic monitoring system market is still considered to be in its infancy. Existing buoys and sensor platforms either utilize solar panels or disposable batteries, both of which need regular servicing visits. By harnessing energy from ocean waves, these servicing visits can be reduced to near zero, along with the associated waste and carbon emissions.

According to Balky Nair, President of Oscilla Power, "This is a great opportunity for OPI to showcase our technology and create a paradigm shift in the in the way ocean instrumentation will be powered in the future."

If this early work is successful, OPI plans to continue to work with project partners to progress into a full ocean demonstration in 2023. While the marine platform will be developed specifically for CODAR during the project, this R&D will lay the groundwork for a variety of ocean sensor systems.
