Attorney David Goldman Announces New Program For At Risk Youth in Sarasota

New Fresno Pedestrian Injury Study Maps Most Fatal Roads

‘Death Sentence’ by Illegal Eviction for 88-Year Old Disabled Widow? L.A. Judge Denies Her Request to Stay Execution

LOS ANGELES, Calif. /ScoopCloud/ -- A Los Angeles Superior Court Judge has cleared the way for the L.A. County Sheriff to evict 88-year old Dorothy Green from her own Brentwood Home of 13 years as soon as Monday morning (February 3). Dorothy's doctor says the eviction is likely to cause serious and potentially fatal harm to Dorothy's health. And her attorney, Larry J. Caldwell, contends the eviction is illegal.

Earlier this week, Dorothy, who is disabled, had filed a request for reasonable accommodation under the Americans with Disabilities Act, asking the L.A. Superior Court for a temporary stay of execution of the eviction.

Dorothy's primary doctor, Alex Gold, M.D., had recommended a 90-day delay of the eviction. "[P]utting Dorothy through the trauma of being evicted from her home now, or in the foreseeable future, will place Dorothy at probable risk of serious harm to her mental and physical health - that could possibly be fatal," in a Declaration filed in court in support of Dorothy's ADA Request.

But on Wednesday, January 30, 2020, Los Angeles Superior Court Judge Daniel Juarez denied Dorothy's ADA request, refusing to delay the eviction at all.

Dorothy's attorney, Larry J. Caldwell, believes "the eviction violates Dorothy's right to reasonable accommodation under the federal Americans With Disabilities Act and California's Fair Employment Housing Act that apply to the L.A. Superior Court and the L.A. Sheriff's Department."

"The eviction is also illegal because Dorothy was denied her constitutionally guaranteed due process rights, including her right to jury trial," said Caldwell.

But according to Los Angeles County Supervisor Sheila Kuehl's office, the Sheriff's Department plans to evict Dorothy anyway, unless a court orders them not to.

L.A. celebrity Peggy McIntaggert Seagren, a Green Family friend, said, "I am truly shocked that the Court and Sheriff would risk killing Dorothy Green while our community is still mourning the victims of the tragic helicopter crash."

"We're all painfully mindful of the priceless value of every human life --and how suddenly a beautiful life can be taken," said Seagren.

Caldwell added, "it will be barbaric if the Sheriff illegally kicks a disabled octogenarian widow out of her own home, putting her life in serious danger."

Dorothy's only income is her monthly social security check. She cannot afford to get another home, or to pay for the cost of moving a lifetime of cherished possessions --mementos of the 60 wonderful years she and her late husband Lloyd shared -- in the dream home they built together.

"Even if Dorothy survives the eviction, why add one more homeless person to L.A.'s already overwhelming homeless crisis?" asked Caldwell.

Dorothy Green plans to file an application for an emergency stay in the Second District Court of Appeal later today.

88-Year Old Widow Asks Court to Block Potentially Fatal Eviction

In a Declaration filed in court, Dorothy's primary doctor, Alex Gold, M.D., has strongly recommended against the eviction, on medical grounds, because "putting Dorothy through the trauma of being evicted from her home now, or in the foreseeable future, will place Dorothy at probable risk of serious harm to her mental and physical health - that could possibly be fatal."

Dorothy's only income is her monthly social security check. She cannot afford to get another home, or to pay for the cost of moving a lifetime of cherished possessions -mementos of the many wonderful years she and her late husband of 60 years shared in the home.

According to Dorothy's attorney, Larry J. Caldwell, "the eviction is illegal because Dorothy was not accorded her constitutionally guaranteed due process rights, including her right to a jury trial."

Added Caldwell, "it will be barbaric if the LASD kicks an octogenarian woman out of her own home based upon an invalid Writ of Possession -- potentially resulting in a death sentence for her."

Monday's hearing is in Dept. 67 at Stanley Mosk Courthouse, in Los Angeles Superior Court Case no. 16STPB01322. If not blocked by the court, Dorothy's eviction could be carried out by LASD as soon as 5 p.m. on Monday.

MediBid Named Potential Optum Competitor in Petition to Deny Public Records Request

KATY, Texas /ScoopCloud/ -- MediBid, an online marketplace where doctors provide bids to patients on medical care to bring competition back into the medical marketplace, along with its CEO, Ralph Weber, were named recently in the Petition for Declaratory Order Denying Representative Martin Daniel's Public Records Request by Optum on December 12th, 2019.

The petition was sent to Laurie Lee, Executive Director of Benefits Administration for the Department of Finance and Administration for the State of Tennessee by representatives of Optum at the Nashville law office of Bradley Arant Boult Cummings, LLP.

Republican State Representative Martin Daniel initiated a request for information, referred to as a data request, from the Tennessee Department of Finance and Administration back in October of this year relating to allowable health care charges, billed charges, and actual amount paid. The public-information request by Representative Daniel was expected to be fulfilled in December of 2019 prior to the petition under Tennessee's Public Records Act.

In the petition, Optum's representatives name Ralph Weber, the CEO of MediBid, as "a potential Optum competitor," after Weber was included in Representative Daniel's request for information as having provided the spreadsheet of fields for the data request. Optum, a part of UnitedHealth Group which is the largest healthcare company in the world by revenue, is in a contract with the State to provide its Behavioral Health Organization services and Employee Assistance Program (EAP), a program for voluntary mental health services, for the public sector health insurance plans.

"At MediBid, we advocate for more transparency in medical costs, which ultimately leads to a reduction in the cost of healthcare," said Weber. "This data request is all about bringing transparency back in. Recently, a MediBid user shared with us that he found an MRI through his insurance cost $2,500 but paid only $250 through MediBid.com. That $2,500 price happened because health insurance has removed all competition and transparent pricing from the medical marketplace, which artificially inflates the price."

Approximately 117,000 medical providers are enrolled on MediBid.com and over 285,000 patients have used the service, including individuals looking for self-pay options, employees from more than 80 employers with self-funded health insurance plans, and faith-based organizations looking for a conservative alternative to the Affordable Care Act. Crawl Space Door Systems, Inc. Announces Court Case Win Against Competitor Making False Claims

VIRGINIA BEACH, Va. /ScoopCloud/ -- On September 24, 2013, Smart Vent filed a lawsuit against Crawl Space Door Systems, Inc. in the NJ Federal Court, case 1:13-cv-05691-JBS-KMW. Crawl Space Door Systems, Inc. filed a counter-claim. The lawsuit is now over and Crawl Space Door Systems won.

"We're happy to announce that the Federal Court ruling finalized what we've known all along - that Crawl Space Door Systems' engineered flood vents are FEMA and NFIP compliant," William G. Sykes, owner, Crawl Space Door Systems, says.

As of October 24, 2019, some of the jury findings revealed that Smart Vent (SV) was unable to prove that Crawl Space Door Systems (CSDS) made false statements about the coverage of CSDS's flood vents; or made false or misleading statements about the purchase and use of CSDS's flood vents to reduce flood insurance premiums.

However, CSDS was able to prove that SV made false claims about CSDS' product statements. More importantly, CSDS was able to prove that SV actually harmed CSDS's business in terms of declining sales and loss of goodwill. CSDS was also able to prove their flood vents do reduce flood insurance premiums.

"We're happy justice prevailed," Sykes says. "SV has a history of filing lawsuits against competitors, but this time we won."

Other companies that SV has filed lawsuits against include: AAA Louvers and Millworks, Inc.; USA Floodair Vents, LTD.; and Vinylast, Inc. They're all out of business now.

Child Sexual Abuse Settlements Obtained from St. Matthew’s Episcopal Day School in The Silicon Valley

SAN MATEO, Calif. /ScoopCloud/ -- Stop School Sexual Abuse (SSSA) announced settlements today of claims totaling more than $1.25 million for two survivors of child sexual abuse by a pre-kindergarten teacher at St. Matthew's Episcopal Day School in San Mateo, California. SSSA volunteers worked with the parties in these claims.

St. Matthew's teacher Anthony Satriano pled no contest to five felony counts of lewd and lascivious conduct, attempted lewd and lascivious conduct and using a child for sexual purposes. The victims, all students at St. Matthew's Episcopal Day School, ranged from 5 to 8 years old and were abused on school grounds during official school activities. Satriano was sentenced to 6 years in state prison and is currently incarcerated at San Quentin Penitentiary.

The survivors alleged that St. Matthew's and Head of School Julie Galles failed to supervise Satriano, allowing him to be alone with students whenever he desired, during which time he took thousands of lewd pictures and videos of young girl students, some of whom he posed or dressed in "encasement" bondage outfits. Satriano sexually abused the students in his classroom and in public school spaces during official school activities (regular class time, after-school enrichment programs, after care or extended care, and school camps).

The cases also alleged that St Matthew's and its employees, including Head of School Galles, ignored Satriano's inappropriate physical contact with students and grooming conduct, failed to have child protection policies and procedures in place, and hired staff that did not meet legally-mandated minimum qualifications. The cases alleged that St. Matthew's and Head of School Galles received many complaints about security but elected to ignore them. These settlements are separate from previously announced settlements.

An important part of victim advocacy is helping survivors and their families address the trauma of betrayal by teachers who abuse and the schools that enable or facilitate the teachers' abuse. Robert Golan Wins Appeal for a Thermometer Factory Worker Denied Monetary Benefits

Battery-gate? Warranty-gate? Charge-gate? Tesla Under Fire After Series Of Class Action Lawsuits

IRVINE, Calif. /ScoopCloud/ -- The Law Offices of Edward C. Chen have filed a series of class action lawsuits against Tesla, Inc. for issues relating to the recent battery fires that have occurred worldwide and for Tesla's used/certified pre-owned car sales.

The first lawsuit, titled "Hugh Nguyen v. Tesla, Inc.," case number 8:19-cv-01422-JLS-JDE, filed in the U.S. District Court, Central District of California, arose after Tesla's continuous denial of a battery replacement for Nguyen's Tesla Model S 60 vehicle.

Our client purchased a used, certified pre-owned (CPO) Tesla vehicle in late 2017. Despite promising a full inspection of the car prior to purchase, Tesla failed to disclose any material information regarding any inspection that was done and failed to inform Nguyen that his car was only capable of reaching 166 miles at maximum battery capacity as opposed to the EPA rated 210 mile estimate for the same year's model.

After nearly two years of back-and-forth with Tesla, it was also discovered that Tesla had potentially failed to display and provide purchasers of its used vehicles with the written "Buyer's Guide" form as required by federal law. The Federal Trade Commission (FTC) is the governmental authority tasked with enforcing the law and can fine offenders and used-car dealers like Tesla with penalties of up to $42,350 per violation.

It is estimated that over 13,000 used, certified pre-owned, Tesla vehicles were sold by Tesla beginning from April 2015. Based on these numbers alone, Tesla would therefore be subject to a payment of penalties for $500 million - or more if the FTC were to seek the maximum penalty per violation in a separate enforcement action.

The second lawsuit, titled "David Rasmussen v. Tesla, Inc.," case number 5:19-cv-04596-VDM was filed in the U.S. District Court, Northern District of California and arose after owners of affected Tesla vehicles began reporting significant range decreases following a series of software updates in May 2019 that appear to have bene issued by Tesla in response to recent cases of battery fires worldwide.

After several months of investigating potential causes for the range decrease, it appears that the most likely culprit is that Tesla discovered a widespread defect involving its Model S and Model X vehicles and knew that their vehicles would be at a high risk of catching on fire if charged to 4.2 volts, or 100% capacity, as advertised and sold to customers.

Lead counsel Edward Chen commented, "Tesla advertises these cars by their battery capacities like 60, 70, 75, 85 kWH etc. Tesla sold these cars with the advertised capacities and knew that they wouldn't be safe if charged fully to max battery capacity. Tesla knew that they shipped out and delivered cars with this defect, yet they failed to inform customers of the defect. They thought that they could sneak around disclosure by using software updates to limit the ability to fully charge the batteries. What happened after, of course, is that owners like [David] my client saw an immediate range drop of approximately 30 miles or so after updating his car with Tesla's updates [2019.16.1 and 2019.16.2].

What's even worse is Tesla's failure to acknowledge the fact that their own software updates limited the battery cap and throttled performance of their cars. They knew this and blatantly lied to people like [David] my client when he tried to get his battery replaced under warranty.

Tesla told customers like David that the range loss he was experiencing was 'normal' despite the obvious fact that a loss in range of approximately 30 miles suddenly and practically overnight is not normal degradation by any means. This is no different than what Apple did to their older iPhones in the throttling and performance case.

Tesla has taken the official stance that it issued these updates to 'improve the longevity of these batteries', when all that really means is that they are attempting to mitigate their liability and are seeking to avoid having to replace all of these batteries under warranty. This is no different than what Apple did by throttling the performance of its older iPhones."

The 19-count complaint alleges that Tesla violated the federal Computer Fraud and Abuse Act 18 U.S.C 1030, Magnuson-Moss Warranty Act 15 U.S.C 2030 and various violations state law and includes fraud causes of action.

Gokal says it took more than a year to get routine employee information about the driver such as his application and prior references from Schwan's. "It's been a long and punitive road for a young woman who had the misfortune of getting a flat tire and trusting a Schwan's employee for help," says Gokal.

In March of this year, Schwan's Co. a multibillion dollar private food company whose brands include MaMa Rosa's, Freschetta, Schwan's Chef Collective, Pagoda, and Edwards was acquired by CJ CheilJedang, a South Korea-based food processor.

"We urge CJ CheilJedang's CEO Shin Hyun-Jaw (https://www.cj.co.kr/en/about/cj-cheiljedang/ceo-message) and Dimitrios Smyrnios of Schwan's to bring this shameful, dishonorable chapter to a close which has caused this innocent woman deep pain and trauma," Gokal says.

According to Co-counsel, Mahyar Ghassemian of the Ghassemian Law Group, Schwan's failed to act on red flags on the driver's application. "Had they contacted his former employer they would have seen he had a prior criminal record," she says.

Robert Golan, PC Wins Appeal to Get Workers Compensation Coverage for Independent Contractor

PLAINVIEW, N.Y. /ScoopCloud/ -- Lately, some businesses in the state of New York have been hiring workers as independent contractors, not as employees in order to avoid providing benefits for these workers, including workers compensation benefits. This hospital wanted to pay her as an independent contractor so they made her sign an Agreement stating that she is an independent contractor.

Our argument to the Judge was that despite the Agreement, she is an employee under the law because the hospital established her hours, her pay, as well as her schedule, and she used the hospital's equipment, supplies and facilities to perform her job duties. In fact, the injury occurred as a result of tripping over a wire in one of the hospital's massage rooms causing her to fall and severely injure her shoulder.

In the initial hearing. the Judge ruled that she is an independent contractor but the firm appealed this decision and got it reversed by the Appeal Court. The massage therapist is now receiving Workers Compensation benefits to cover her medical treatment and necessary medical supplies for her recovery, as well as receiving weekly monetary benefits as she recovers from her injury.

"This ruling is important because it helps define the differences between an employee and an independent contractor in the eyes of an employer," said Robert Golan, PC. Jury Acquits Ex-Judge in DNR Trespass Case

AITKIN, Minn. /ScoopCloud/ -- Following a three-day trial, an Aitkin County jury recently found retired district court judge Robert Graff not guilty of trespassing in the DNR Savanna State Forest in Aitkin County, the Peterson Law Office announced today.

The Aitkin County Attorney had charged Graff with driving a pickup truck from his home near McGregor, Minnesota, across state forest land to the shore of Bass Lake. The criminal complaint asserted that vehicle traffic was illegal at that place in the forest.

The crime alleged carried possible jail up to 90 days, a fine of up to $1,000 and three times the value of damages to the land payable to DNR.

The evidence submitted against Graff was a photograph taken by a mechanical trail camera posted by a DNR conservation officer. The officer testified at trial that she could identify Mr. Graff on the trail camera photo to be the person behind the wheel of the pickup truck.

Graff was represented by Bloomington attorney Bill Peterson who argued that the game warden did not take the picture so her testimony was merely her interpretation of the photograph which the jury could determine for itself.

"Trail cameras often snap random pictures that are blurred, as here, so positive identification claimed by DNR is not possible," said Peterson. The jury agreed and acquitted Graff who did not need to testify.

"We are gratified that the jury concluded that the trail camera photograph did not prove what DNR alleged and that it exonerated Judge Graff," said Peterson.

The jury verdict ends the prosecution and the state is barred from appealing the jury's decision.

Dubbed the "Butterfly Palladium," the project was to be the newest and highly sought after tourist attraction in Buena Park's plans to overhaul its aging entertainment corridor, which includes and surrounds Knott's Berry Farm.

With construction already underway at the location once home to the historic Movieland Wax Museum on popular Beach Blvd. in Buena Park., the state-of-the-art Butterfly Palladium project is a 56,000 square foot unique entertainment venue that includes 22,200 square feet of exotic butterflies, magnificent hummingbirds, a realistic rainforest atrium, and the largest jellyfish aquarium in the world. The center also incorporates additional wildlife, a 3D movie theater, education room, cafe, retail shop, and more activities for visitors to experience.

John Bowerbank, a partner at GRBB, says that the City of Buena Park acted arbitrarily and capriciously to deny an extension to complete construction.

"By denying the extension to complete the project, and filing a frivolous lawsuit to force a repurchase of the property even though the City has no right to repurchase the property, the City has attempted a thinly veiled regulatory taking that amounts to nothing more than a malicious attempt at a land grab," asserted John E. Bowerbank, partner at GRBB. "The city's legal strategy will cause significant monetary exposure to the City, is completely baseless, and their lawsuit was filed simply as a ruse to squeeze the developer into abandoning the project, which north of $15 million has already been invested."

Bowerbank continues, "We will not capitulate to the city's attempts to bully our client into duress. Ultimately, this will become costly litigation and a futile undertaking done at the expense of taxpayers, not to mention further postponement of completing an outstanding entertainment venue and coveted attraction for local communities and visitors from all over the world to enjoy. Our client intends to file and vigorously prosecute a cross-complaint that seeks significant damages against the City as well as attorneys' fees and costs."

Situation and Legal Overview:

The City of Buena Park ("City") has filed a lawsuit following a failed attempt to strong arm Butterfly Pavillion LLC ("Butterfly") into allowing it to repurchase the location. This was done after the City Council improperly denied Butterfly's reasonable request for an extension in January 2019. The project is a highly unique concept that recreates a Central American rainforest theme built on a nine-acre development with architectural components designed and constructed from around the world. As a direct result of the novel nature of the special project, the endeavor has not been without expected hurdles, which can be overcome, and the Development Agreement itself contemplated the need for extensions to the limited construction time initially provided. Instead, as part of a meritless land grab, the City has flip-flopped and now attempts to rewrite the Development Agreement to achieve its ulterior motive using costly litigation.

Any option by the City to repurchase the Property was, in fact, terminated jointly by the parties on October 10, 2017, making it a moot argument. Moreover, the City knew at the time the construction schedule had been modified that an extension would be required. Indeed, the City's lawsuit seeking to enforce a non-existent option to purchase plainly constitutes malicious prosecution in addition to sanctionable conduct. This is a woeful attempt to undermine Butterfly's development efforts and is also a gross, egregious misuse of taxpayer funds.

Butterfly has attempted to schedule numerous meetings with City officials to no avail. Despite the City's questionable tactics and flip-flopping, Butterfly still believes it is in the best interest of the Developer, City, and most importantly, the people of Buena Park, to complete the construction and installation of this beautiful addition to the City's Entertainment Corridor. But in order to do so unencumbered, the Developer must be allowed the previously agreed upon extension of time to complete installation of the Project.
